These terms govern your use of nesthavi.com and every order placed through it. By browsing the site or buying from it you accept them. If you do not accept them, please do not use the site.
1. Who we are
Nesthavi is an independent print-on-demand apparel studio. This site is operated by Nesthavi Limited, a company registered in Hong Kong, with its registered office at Suite C, Level 7, World Trust Tower, 50 Stanley Street, Central, Hong Kong. In these terms "we", "us" and "Nesthavi" mean Nesthavi Limited; "you" means the person using the site or placing an order.
2. Eligibility
You must be at least 18 years old, or old enough to enter a binding contract where you live, to place an order. By ordering you confirm that the payment method you use belongs to you or that you have permission to use it.
3. Products
Every item is printed to order. We photograph and describe our products as accurately as we can, but printed colours can shift slightly between batches and screens render colour differently. Small variations in print placement are a normal feature of direct-to-garment printing and are not defects. Garment measurements are listed on each product page — please use them rather than the size you usually buy elsewhere.
4. Prices and availability
All prices are shown in US dollars and exclude any sales tax, which is calculated at checkout where the law requires it. We may change prices, run promotions, or withdraw a design at any time. If a design is withdrawn after you order it, we will contact you and refund you in full.
If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the order and refund it rather than fulfil it. We will always tell you before doing so.
5. Orders and acceptance
Your order is an offer to buy. A contract is formed when we send the order confirmation email. We may decline or cancel an order — with a full refund — if the item cannot be produced, if payment cannot be verified, if the delivery address is outside our network, or if we have reason to believe the order is fraudulent.
6. Payment
Payment is taken in full when you place the order, because production starts straight away. Accepted methods, security and dispute handling are set out in our Payment & Security policy.
7. Shipping and delivery
Production and transit times, shipping fees, tracking and customs are covered in our Shipping & Delivery policy. Delivery estimates are estimates, not guarantees.
8. Returns and refunds
Because items are made individually, returns are limited to faults, damage and our own mistakes. The full position is set out in our Returns, Refunds & Replacements policy, which forms part of these terms.
9. Your account
If you create an account, you are responsible for keeping your password confidential and for activity that takes place under it. Tell us immediately if you believe your account has been used without your permission. We may suspend or close an account that is used for fraud, abuse, or repeated chargebacks made in bad faith.
10. Acceptable use
You agree not to use the site to break the law, to interfere with its operation or security, to scrape or copy it systematically, to resell our product images as your own, or to submit content that is unlawful, abusive, or infringes somebody else’s rights.
11. Intellectual property
The Nesthavi name, logo, site design and original artwork are protected. You may not reproduce them commercially without written permission. Our position on third-party rights, and how to report a design you believe infringes yours, is set out in our Intellectual Property & DMCA policy.
12. Reviews and submissions
If you post a review, photo or comment, you confirm it is your own and you give us permission to display it on the site and in our marketing. We may remove content that is off-topic, abusive, or not genuine.
13. Third-party links
The site may link to services we do not control, such as payment providers and carriers. We are not responsible for their content or their policies; their terms apply when you use them.
14. Limitation of liability
To the fullest extent the law allows, our liability for any order is limited to the amount you paid for it. We are not liable for indirect or consequential loss, including missed occasions caused by a delivery delay. Nothing here limits liability that cannot lawfully be limited, and nothing here removes the statutory rights you have as a consumer.
15. Force majeure
We are not responsible for delay or failure caused by events beyond our reasonable control, including extreme weather, strikes, carrier failures, customs action, power or network outages, and public health measures.
16. Changes to these terms
We may update these terms. The version published on this page when you place an order is the version that applies to that order. The date at the foot of the page shows when it was last changed.
17. Governing law
These terms are governed by the law of the jurisdiction in which Nesthavi operates. Where consumer protection law in your own country gives you stronger rights, those rights continue to apply.
